Background & Experience
In 2004, I became the director and owner of the family care business, which my mother established in 1968. Over the many years, we recruited and placed every level of domiciliary staff, specialising in care for the elderly or infirm, childcare and housekeeping.
Conditions:
Dementia, Cancer, Parkinson’s, Physical Disability, Mental Health, Palliative Care and Special Needs.
Staff:
Carers, Nannies, Mothers' Helps, Maternity Nurses and Domestic Staff.
For many years, it has also been an integral part of our service to find appropriate support for clients who have suffered personal injuries and medical negligence. Having had discussions with a variety of solicitors, we realised that we could provide this valuable service as an Expert Witness.
We have provided ‘Domiciliary Quantum and Staff Placement Reports’ on Personal Injury and Medical Negligence cases for the past thirty years, which is now my main focus.

Quantum
If someone has been permanently injured due to an accident or medical negligence, they may need full or part time care and support. It also needs to be considered whether their dependants need domestic assistance. Obviously is it vital, if possible, for claimants to remain living in their own home.
The cost of providing the care services for someone who has suffered a personal injury or medical negligence, is not always specifically calculated. Whilst the 'Ogden Tables' are designed to ensure claimants are not under or over compensated, damages awarded are frequently not in line with the actual cost of the relevant care required.
In my experience, the industry rates are considerably higher.
- Daily Care: most agencies provide teams of carers who attend in pairs.
- Live in Care: usually self-employed but registered with an agency.
- Night Care: cost depends on whether this is a waking or sleeping night.
- Palliative Care: can be a combination of the above, and may require a qualified nurse.
- Nannies: fully qualified with a minimum of a NVQ Level 2.
- Mothers' Helps: have a lot of childcare experience.
- Maternity Nurses: require Diploma Level 5 or Cache Level 3 plus Post Natal Care Certificate.
- Special Needs: must have specific training in the particular needs of the child, such as spina bifida, paralysis, brain damage.
Domiciliary care can be extremely sensitive and personal. Understanding clients' needs is particularly important and can be complicated to calculate. Whatever their misfortune, my report and quantum is always based on the real cost of providing the required domiciliary support.
Example cases
Quantum calculated for previous cases
The examples listed below are spread over many years. Costs are considerably higher now.
My reports are specifically focused on the current cost of domiciliary care for any age group that are no longer able to manage life by themselves due to unforeseen circumstances.
A gentleman in his early 60’s and of very good health, had a simple hernia operation which went seriously wrong. As a result, he became wheelchair bound which also triggered serious mental health issues. His wife had to finish work but was not able to look after him without 24 hour high level assistance. They had big plans for their retirement. He did all the manual work around the house and had a successful property business.
A mother was killed in a road traffic accident. She was the principal carer of their four children as well as being responsible for all domestic duties in the house. Her husband worked till 8pm and was away regularly on business. There was no other family members who could assist with the children, aged between 4 – 14. Quantum was calculated for providing appropriate childcare and housekeeping services.
A young mother sadly died during the birth of her first child. Her husband made a claim for medical negligence against the hospital. He had to employ a Maternity Nurse, Housekeeper and experienced Nanny to cover the loss of the Mother's Services.
A three-year-old girl tragically lost both her parents in separate car accidents. She would have been taken into care had her mother’s sister not adopted her. Her aunt, who already had two children, could not get any financial support from the local authorities or any additional Tax Credits. Quantum was calculated after assessing the Loss of the Mother’s Services.
An elderly gentleman relied upon his wife for all his care, domestic duties and transportation. Due to her accident, she was his able to provide this care. Quantum was calculated to cover the cost of providing a daily carer and domestic assistance services.
A lady was crossing the road when she was knocked down by a car. She suffered severe injuries which considerably affected her mobility and lifestyle, to the point that she was unable to leave her house. She also had mental health issues and her son, who had learning difficulties, lived with her. She required regular visits from Daily Carers to assist her with personal care and household services.
A young mother who suffered from serious gynaecological symptoms and was not properly treated by the NHS, for over two years. She was in incredible pain and eventually was diagnosed with terminal cancer. The treatment was unsuccessful and sadly she died. She left two young sons and a husband who worked long hours. A review of her tests in 2010, showed severe dyskaryosis which if not treated can develop into cervical cancer.
